DWC Issues Notice of 15-Day Public Comment Period for QME Process Regulations
The Division of Workers’ Compensation (DWC) has issued a notice of public comment period beginning on May 12, 2023, for modifying the text of proposed amendments to the Qualified Medical Evaluator (QME) Regulations. The affected regulations are Title 8, California Code of Regulations Sections 1, 11, 11.5, 14, 33, 35, 35.5, 50, 51, 52, 54, 55, 56, 57, 63, 10133.54 & 10133.55. (QME Process Regulations).
DWC will consider all public comments. The 15-day notice of modification to the text of the proposed regulations and the text of the regulations can be found on DWC’s rulemaking page.

DWC Accepting Applications for Qualified Medical Evaluator (QME) Examination April 15 through 22, 2023
The Division of Workers’ Compensation (DWC) is now accepting applications for the Qualified Medical Evaluator (QME) examination for April 2023. The examination will be held between April 15, 2023 and April 22, 2023.
QMEs are independent physicians certified by the DWC Medical Unit to conduct medical evaluations of injured workers. The application and Registration packet for the QME exam can be downloaded from the DWC website. Applicants may also contact the Medical Unit at 510-286-3700 to request an application via U.S. mail, email, or fax. The deadline for filing the exam applications is March 1, 2023. No applications will be accepted after this postmarked date. For more information, contact the Medical Unit at 510-286-3700 or by email at QMETest@dir.ca.gov.

The DWC is working with the Office of Administrative Law (OAL) to make changes and updates to regulation 36.7. These changes will require a 15-day public notice and comment period. DWC intends to pursue these updates.
During the period that this regulation is not in effect, service of a medical-legal report and documents shall be done as set forth in regulation 36.

The Division of Workers’ Compensation (DWC) has issued a Notice of Emergency Regulatory Action to address the ongoing need for telehealth medical-legal evaluations and office location flexibility resulting from various state and local public health safety measures. These emergency regulations will help injured workers and employers continue to move their workers’ compensation claims towards a resolution and avoid additional and undue delay. DWC Emergency Regulations for Medical-Legal Evaluations and Reporting in Response to COVID-19 in Effect through January 11, 2022. The Office of Administrative Law (OAL) approved the emergency regulations on September 30. This is DWC’s second and final re-adoption in accordance with Government Code section 11346.1(h).
